Seattle e-commerce tech startup, Replenium, known for its innovation in automating groceries, recently accused grocery chain Albertsons Companies of pilfering its trade secrets. Replenium says Albertsons ended their working relationship, originally dated at three years, and employed these secrets to create its own version.

Lawsuit – A Signal to Misconduct

Replenium lodged a lawsuit against Albertsons on Monday in U.S. District Court in Seattle. The litigation cites misappropriation of trade secrets, breach of contract, and seeks compensation for losses suffered due to Albertsons’ alleged actions.

Over the course of their association, Albertsons continually urged Replenium to persist with its work on the Replenium Platform. Numerous missed deadlines and countless delays by Albertsons, coupled with significant financial expenditure by Replenium, culminated in the current litigation.

False Promises and Unmet Deadlines

The lawsuit alleges that “Albertsons made statements knowing that they were untrue,” essentially encouraging Replenium to continue work on the platform in the promise of earning back its expenses through Service Fees.

An Albertsons representative, when approached by GeekWire, declined to comment on the allegations.

The company’s Chief Technology Officer (CTO) Umair Bashir, another ex-Amazon e-commerce and retail technology executive, enhances its pedigree. To date, Replenium has raised over $18 million in funding according to PitchBook.

Albertsons Ties and Pending Merge

Albertsons, based in Boise, Idaho, controls Safeway, Vons, Jewel-Osco, and several other major grocery brands. It intends to merge with The Kroger Co., known for Fred Meyer, QFC, Kroger, in a deal worth $24.6 billion.

Replenium claims that the proposed expansion of the technology to Kroger following the merger baited the startup to continue its partnership. However, the lawsuit now claims that Albertsons was concurrently building its own competitive grocery basket auto replenishment solution whilst working with Replenium. Albertsons allegedly used confidential information shared over the course of their three-year engagement to achieve this.
